All provinces in Canada have immigration pathways for entrepreneurs who are looking to invest between $150,000cad to $200,000cad in any business of their choice. Theres also a requirement for these entrepreneurs to have a net worth of bwtween $300,000cad to $700,000cad. Some provinces even demand that the entrepreneur deposits up to $50,000 with the province, which can only be returned after the entrepreneur sets up and operates his business for at least 1 year.
Another feature of Canada's provincial business immigration pathway is that it is operated pretty much like the express entry where prospective entrepreneurs have to make an expression of interest (EOI) to the province and if theyre successful, they are put into a pool with other entrepreneurs and the highest ranking indivituals are invited to apply. The provincial business immigration pathway processing time can also take up to 1 year.
The Federal Owner Operator Pathway
The federal owner operator is also a business immigration pathway in Canada. The entrepreneur in this case is not a passive investor like in the provincial business immigration. The entrepreneur in this pathway is fully involved in the daily running of his business eg as a Manager.
How does the Federal Owner Operator Work?
There are several steps that a prospective federal owner operator must take to immigrate to Canada. The entrepreneur is expected to buy a viable/profitable business in Canada or buy at least 50.1% shares of a Canadian business and apply for LMIA to work in the business. A work permit of up to 2years is approved for the entrepreneur. After at least 1 year of operating the business, the entreprenuer can apply for permanent residence under the express entry program (organised job offer in Canada category).
What is LMIA?
It means "labour marker impact assessment". It is an assessment used by the Canadian government to determine if an employer is denying a Canadian citizen or permanent resident a job by offering the same job to a foreign worker. A job can only be given to a foreign worker after it has been advertised and no citizen or permanent resident was found to take up the job. The employer has to provide proof of job advert/ or failed attempt to hire within Canada when applying for an LMIA. A positive assessment will give the employer the authorisation to hire from outside Canada.
The LMIA for the Owner Operator does not require a job advert because a Canadian citizen or permanent residence is not being denied your job as the CEO of your own company.
Minimum required investment
There is no minimum investment requirement for the owner operator pathway. But most business consultants believe that a business investment of at least $100,000 should be ok.
Steps to get started with the Canada Owner Operator business immigration
1. Locate a business to buy and make contact with the buyer.
2. Obtain a business visitor visa and visit Canada
3. Do your due diligence on the identified /prospective business
4. Get a business consultant to write a business plan, highlight its profitability and ability to provide an income for you and how it has the prospects of employing Canadians and permanent residents
5. Purchase the business
6. Apply for LMIA. You need to submit your business plan with the LMIA. Positive LMIA will grant you a work permit of up to 2 years
7. When you recieve work permit. You can start to work as your business manager..get SIN (social insurance number)
8. After at least 1 year of operation, you can apply to live in Canada permanently under the job offer in canada route of the express entry program.
What is the time frame for processing immigration under the federal owner operator program?
There are 2 major steps
1. LMIA application. This takes between 1 to 3months to be approved
2. Work permit application. This also takes between 1 to 3 months to be approved.
So if all goes well, after the purchase of the business, and LMIA application you can legally live and operate your business in Canada under 6months or less.
Is the family of the Owner Operator allowed to move to Canada with him/her?
Yes. Immediate family can move with the entrepreneur immediately
